Man Accused of Stabbing Iryna Zarutska Aboard N.C. Light Rail Train Deemed Incompetent to Stand Trial by Doctors

Legal proceedings against the man accused of fatally stabbing a Ukrainian refugee aboard a Charlotte light rail train have reached a standstill. A state psychiatric evaluation recently determined that 34-year-old Decarlos Brown Jr. is mentally “incapable” of proceeding to trial.

According to a motion filed on April 7, 2026, by Brown’s defense team, a December 2025 report from a state psychiatric facility concluded that Brown lacks the mental capacity required for the legal process. Under North Carolina law, the high-profile case cannot move forward until a judge rules that Brown’s competency has been restored.

The charges stem from the August 22, 2025, slaying of 23-year-old Iryna Zarutska. The attack, which took place on a Lynx Blue Line train, was captured on surveillance video. Federal investigators described a chilling scene: Brown allegedly unfolded a knife and struck Zarutska three times as she sat directly in front of him.

Zarutska, who had recently emigrated from Kyiv to escape the war in Ukraine, was pronounced dead at the scene. U.S. Attorney Russ Ferguson previously characterized the murder as a “terroristic act” and an assault on the “American way of life.”

While Brown faces state-level first-degree murder charges, federal prosecutors have also charged him with committing an act causing death on a mass transportation system. Due to the nature of the crime, the Department of Justice is seeking the death penalty.

Brown’s public defender is currently seeking a hearing, slated for later this year, to challenge the pursuit of capital punishment. However, any movement on sentencing or trial remains contingent on Brown’s mental health status.

The stabbing has sparked intense scrutiny of the local justice system. Records show Brown’s criminal history dates back to 2007, including a 2014 conviction for robbery with a dangerous weapon.

Most notably, Brown was arrested for misusing 911 just weeks before the killing. Despite his public defender requesting a forensic evaluation in July 2025—citing concerns over his mental state—Brown was released on a written promise to appear. Less than a month later, Zarutska was killed.

Zarutska’s family, who chose to bury her in the United States because of her love for her new home, continues to await justice. For now, that justice remains delayed by a medical determination of the suspect’s mental instability.
