Sen. Mark Kelly Responds After Trump Shares Early-Morning Post Calling for Retired Navy Captain’s Imprisonment

Arizona Senator Mark Kelly issued a defiant response Wednesday after Donald Trump amplified calls for the retired Navy captain’s imprisonment, labeling Kelly’s advocacy for military legal standards as “treasonous.”

The confrontation marks a significant escalation in a long-standing feud between the Trump administration and the veteran astronaut over the boundaries of free speech for retired service members.

Early Wednesday morning, Trump shared a post on Truth Social demanding Kelly be “held accountable” for a video the Senator produced alongside other veteran lawmakers. The post, which included the command “LOCK HIM UP.!!!”, referred to a video in which Kelly reminded active-duty service members of their legal obligation to refuse “illegal orders.”

“If Donald Trump thinks that these threats will intimidate me or keep me from standing up for the free speech rights of Americans, he’s got the wrong guy,” Kelly said in a statement to the press.

The dispute originated in November when Kelly and Representative Elissa Slotkin (D-Mich.) released a video addressing the military directly. The message followed controversial deployments of the National Guard to U.S. cities and military strikes in South America and Iran.

“Our laws are clear: you can refuse illegal orders,” Kelly stated in the footage.

The administration’s response was swift. Trump previously characterized the video as “seditious behavior” punishable by death. In January, Defense Secretary Pete Hegseth moved to strip Kelly of his military pension and demote him from the rank of captain, citing “reckless misconduct.”

The Pentagon’s attempt to punish Kelly has stalled in the judiciary. A federal judge recently blocked the Defense Department from seizing Kelly’s benefits, a ruling the administration is currently appealing.

In an April 15 filing with the federal appeals court, Kelly’s legal team argued that military service does not result in a “lifetime restriction” on constitutional rights. The filing described Hegseth’s actions as “textbook retaliation against protected speech.”

Kelly, a former NASA astronaut who flew 39 combat missions during Operation Desert Storm, has remained a vocal critic of the Pentagon’s current leadership. He recently labeled Hegseth “the most unqualified Secretary of Defense in our country’s history.”

As the appeals court prepares to hear the case, the outcome will likely set a major precedent regarding whether the Department of Defense can discipline retired officers for political speech.
