Supreme Court Deals Major Blow to Trump Removal

The Supreme Court has temporarily blocked President Donald Trump from removing Shira Perlmutter, the register of copyrights, allowing her to remain in her position while the justices consider related legal challenges.

At the center of the dispute is whether the Copyright Office is part of the legislative branch and how much power a president has to remove officials who lead such agencies.

For now, the court has decided to wait for rulings in connected cases involving the Federal Trade Commission and the Federal Reserve before issuing a final decision on Perlmutter’s status and the broader constitutional questions.

Debate Over Separation of Powers

Skye Perryman, president and CEO of Democracy Forward, welcomed the court’s move, saying, “We are pleased that the Court deferred the government’s motion to stay our court order in a case that is critically important for rule of law, the separation of powers, and the independence of the Library of Congress.”

The White House took the opposite view. Spokeswoman Abigail Jackson said, “President Trump exercised his lawful authority as head of the executive branch to remove an officer exercising executive authority. We look forward to ultimate resolution of this issue by the Supreme Court.”
